An article by Bonner Cohen, forthcoming in the May issue of Environment & Climate News, reports:

"Fed up with the federal government locking up state lands rich in economically productive natural resources, Utah Gov. Gary Herbert (R) has signed a bill authorizing the state to use eminent domain to seize federal lands and open them up for energy production."

Now, I'm generally not a big fan of eminent domain, but I LOVE the idea of a state government using that against the federal government!

Is there some slippery slope I'm missing here?

Yes. Boo for the tobacco tax, but that's an inspired move to seize federal land via eminent domain. I doubt it will succeed, but it sure raises interesting questions about government power. A lot of that federal land, as I understand it, has been "protected" via presidential executive order. Seizing that land, as opposed to lands Congress set aside explicitly, might have some merit.

And Boooooooo to Gov. Herbert. According to U.S. News and World Reports, "In what some are calling "a late-night, behind-closed-doors deal," Herbert recently put his signature on legislation that increased the state's tobacco tax, provoking the ire of the Tea Party movement and putting the governor's re-election bid in jeopardy."
